1. Agreement and Eligibility
These Terms of Service ("Terms") govern your access to and use of the ASO Expert application and web dashboard (the "Service"), operated by Lê Quốc Hoàng, based in Ho Chi Minh City, Vietnam ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) to use ASO Expert. If you are using the Service on behalf of a company, you represent that you have the authority to bind that entity to these Terms.
2. Account Security
You must create an account to use ASO Expert. You are responsible for: providing accurate registration information, maintaining the security of your account credentials, all activity that occurs under your account, and notifying us immediately of any unauthorized use. We use Clerk for authentication, supporting Apple Sign In, Google Sign In, and email/password.
3. Acceptable Use
You agree to use the Service for lawful purposes only. You may not: use automated scripts or bots to scrape data from the Service, resell or redistribute data obtained through ASO Expert, attempt to interfere with or disrupt the Service's infrastructure, create multiple free accounts to circumvent tier limits, use the Service to violate any third party's intellectual property rights, reverse engineer or decompile any part of the Service, use the Service to develop a competing product, share your account credentials with others, or upload malicious code. We reserve the right to suspend accounts that violate these Terms.
4. Subscription Terms
ASO Expert offers Free, Basic ($9.99/month or $79.99/year), and Pro ($19.99/month or $159.99/year) subscription tiers. Current feature limits are displayed within the app. Paid subscriptions are processed through Apple's In-App Purchase system via RevenueCat. Payment is charged to your Apple ID account at confirmation. Subscriptions auto-renew unless cancelled at least 24 hours before the billing period ends. Manage subscriptions in your device's Settings > Apple ID > Subscriptions. Any unused free trial portion is forfeited upon purchase. Prices may change with at least 30 days' advance email notice.
5. Refund Policy
All subscription payments are processed by Apple and subject to Apple's refund policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We do not process refunds directly. Upon a successful refund, your subscription tier will be downgraded to Free at the end of the current billing period.
6. AI Features and Generated Content
ASO Expert includes AI-powered features using Google Gemini, OpenAI, and Anthropic Claude to generate keyword suggestions, optimization recommendations, and content. AI features require your explicit consent before any data is sent to providers. You can revoke consent at any time in Settings. AI-generated content is for informational purposes only — we do not guarantee its accuracy, completeness, or originality. You are solely responsible for reviewing and deciding whether to use any AI-generated content. Using AI suggestions does not guarantee improvement in rankings, downloads, or revenue.
7. Data Accuracy
ASO Expert relies on third-party data sources including Apple's iTunes Search API, SerpAPI, and SearchAPI. You acknowledge that: App Store rankings change frequently and are controlled by Apple, ranking data may have slight delays or inaccuracies, keyword difficulty and opportunity scores are estimates not guarantees, competitor detection is algorithmic and may not capture all competitors, and chart positions reflect snapshots in time. We strive for accuracy but cannot guarantee the completeness or timeliness of data.
8. Intellectual Property
The Service, including its design, code, features, and brand assets, is our property protected by intellectual property laws. You retain ownership of the app data and keywords you input. By using the Service, you grant us a limited license to process your data solely for providing the Service. This license terminates when you delete your account. If you provide feedback or suggestions, you grant us a non-exclusive, royalty-free license to use such feedback to improve the Service.
9. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) We are not liable for any indirect, incidental, special, consequential, or punitive damages. (b) Our total liability shall not exceed the greater of the amount you paid in the 12 months preceding the claim or $100. (c) We are not liable for business decisions based on data or AI suggestions from the Service. (d) We are not liable for actions of third-party services. Some jurisdictions do not allow limitation of liability — in such cases, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless ASO Expert from any claims, damages, losses, and expenses arising from: your use of the Service in violation of these Terms, your violation of any law, your infringement of any third party's rights, or content you submit to the Service. This may not be enforceable in all jurisdictions, particularly for consumer users in the EU.
11. Account Termination
You may delete your account at any time from Settings. All your data is permanently removed as described in our Privacy Policy. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or create an unreasonable burden on our infrastructure. Where possible, we provide notice and an opportunity to remedy before termination. Active Apple subscriptions must be cancelled separately.
12. Dispute Resolution
These Terms are governed by the laws of Vietnam. Before filing any formal dispute, you agree to contact us at legal@asoexpert.cc and attempt to resolve the dispute informally for at least 30 days. Any disputes not resolved informally shall be submitted to the competent courts of Ho Chi Minh City, Vietnam, except that EU/EEA residents may bring claims in their country of residence as permitted by EU consumer protection regulations. To the maximum extent permitted by law, disputes will be conducted only on an individual basis, not as class actions.
13. Force Majeure
We are not liable for failure or delay in performing our obligations due to circumstances beyond our reasonable control, including: natural disasters, acts of government, changes to Apple's App Store policies or APIs, third-party service outages, internet disruptions, cyberattacks, or pandemic-related restrictions.
14. Changes to Terms
We may update these Terms from time to time. For material changes, we will update the date above, notify you via email at least 30 days before changes take effect, and display a notice in the app. Continued use after changes take effect constitutes acceptance. If you disagree, stop using the Service and delete your account before the effective date.
15. General Provisions
Severability: if any provision is found unenforceable, the remaining provisions continue in effect. Entire Agreement: these Terms and our Privacy Policy constitute the entire agreement. Assignment: you may not assign your rights without our consent; we may assign ours without restriction. Waiver: failure to enforce any provision does not constitute a waiver. Notices: we send notices to your registered email address.
